Anukampa Niyukti (Compassionate Appointment): Dependent Quota Aur 5% Rule Ka Ground Reality

1. Who is Eligible as a 'Dependent'?

Lekin Supreme Court aur recent DoPT directives ke baad, ab 'Married Daughter' ko bhi anukampa niyukti ka hakdar (eligible) mana jata hai, basharte (provided) wo prove kar sake ki wo financial taur par poori tarah apne deceased pita/mata par nirbhar (dependent) thi aur family members use NOC (No Objection) dein.
2. The 5% Ceiling Limit (Asli Rukawat)
- Anukampa Niyukti koi right (fundamental right) nahi hai, ye ek concession hai. Government departments sirf apni total direct recruitment vacancies (Group C posts) ka maximum 5% hissa hi Compassionate Appointment ke liye reserve kar sakte hain.
- Agar kisi saal department me 100 vacancy aati hain, to sirf 5 seats par anukampa niyukti ho sakti hai. Agar application dene wale 20 families hain, to bache hue 15 families ko waitlist me daal diya jata hai.
- Yahi 5% ceiling rule wo karan hai jiski wajah se Railway, Postal aur Defense departments me hazaaron dependent candidates saalon tak pending files ke sath wait karte rehte hain aur unki age limit nikal jati hai.
3. The Relative Merit Point System (RMC)
Jab seats kam hoti hain aur applicants zyada, to department ek Committee banata hai jo 'Indigent Condition' (Gareebi ki sthiti) check karti hai. Iske liye ek 100-point scale use hota hai.
Points kaise milte hain: Agar deceased employee ki death jaldi (chhoti umar me) hui hai, to uski bachi hui service (years left) ke hisab se high points milte hain. Family me minor (chhote) bache kitne hain, unmarried betiyan kitni hain, uske base par points milte hain.
Penalty Points: Agar family ko death ke baad acha Terminal Benefit (Gratuity, PF) mila hai ya Family Pension achi bani hai, to points kaat (deduct) liye jate hain. Jiske maximum points bante hain, committee use pehle job offer karti hai. Isliye sometimes lower post ke employee ki family ko preference mil jati hai over higher post officer's family.
4. Post Allotment Aur Educational Qualification
Ye zaroori nahi hai ki agar deceased pita Superintendent (Level 6) the, to bete ko bhi wahi rank milegi. Anukampa niyukti normally Group C (MTS, LDC) level par hi di jati hai. Aapko job aapki current educational qualification ke aadhar par di jati hai.
Agar candidate sirf 10th pass hai, to use MTS banaya jata hai. Agar candidate temporarily unqualified hai (jaise typing nahi aati), to department use join karwane ke baad ek saal (ya specified time) ka grace period deta hai wo skill acquire karne ke liye. Typing pass na karne par baad me nikalne ka provision bhi hota hai.
