Sarkari Job Me RTI (Right To Information) Handle Karna: CPIO/PIO Ki Responsibility Aur Fine Ka Khatra
Jab ek candidate Group B (Inspector/Superintendent/ASO) ya Group A (Officer) level par Central ya State Government me join karta hai, to use ek aurat-bhar (honorary) parantu behad stressful statutory (vaidhanik) responsibility di ja sakti hai: Use office ka Central Public Information Officer (CPIO) ya PIO designate kar diya jata hai. Aam janta (citizens), rti activists, ya even disgruntled (naraz) ex-employees lagatar department ko Right to Information (RTI Act, 2005) ke under queries bhejte rehte hain: 'Cut off list share karo', 'Transfer file ki copy do', ya 'Mera fund kyu ruka uske notings ki copy do'. Ek naya officer aksar RTI requests ko aam citizen charter applications samajh kar randomly handle karta hai. Lekin RTI Act ek semi-judicial act hai, jisme timeline break hone par ya information chupane par Chief Information Commission (CIC) seedhe us individual officer (CPIO) ki salary se ₹25,000 tak ka personal fine kaat sakta hai. Is strictly technical and administrative post me hum clear karenge ki ek CPIO ke roop me RTI handle karte waqt kaunsi Section 8 exemptions aapka shield ban sakti hain, aur 30-din ki tick-tocking clock ka proper administrative fix kya hai.
1. The 30 Days Deadline Aur 'Section 5' Routing
RTI Act ka basic rule hai ki CPIO ko RTI application completely receive hone ke theek 30 din (30 days) ke andar-andar citizen ko clear aur factual reply speed post/portal ke through bhejna hi hoga.
Agar application CPIO (Aap) ko galti se mili hai aur wo data kisi doosre office/department se related hai, to aap application ko physically rakh kar 30 din waste nahi kar sakte. Rule 6(3) ke tehat aapko application exactly 5 din ke andar-andar concerned proper CPIO ko 'Transfer' (forward) karni hoti hai aur applicant ko iska letter bhejna hota hai. Aisa karte hi aapki legal responsibility us dusre officer par shift ho jati hai.
2. Penalty Provision (Personal Salary Deduction)
- Agar citizen satisfied nahi hai to wo First Appeal (aapke boss ko) aur uske baad Second Appeal CIC/SIC ko karta hai.
- Agar CIC sunwai (hearing) me ye decide karta hai ki CPIO (Aapne) intentional delay (mala-fide intent) kiya hai, ya file ko deny kar diya joki public right tha, to Commissioner officer par ₹250 per day (maximum Rs. 25,000 tak) ka fine personally impose karta hai.
- Dhyan rahe, ye ₹25,000 department pay nahi karta, ye formally CPIO ki personal basic salary account se next month recover kiya jata hai aur service book me negative marking count ho sakti hai.
3. The Ultimate Shield: Section 8 (Exemptions)
Aapko RTI me poore desh ki khuli kitab (open book) banne ki zarurat nahi hai. RTI Act ka Section 8 CPIOs ko legal protection (kawach) deta hai jahan wo confidently information deny kar sakte hain. Aapko theek paragraph quote karna aana chahiye.
Section 8(1)(j) - Personal Information: Agar koi outsider (A) aakar dusre employee (B) ki APAR grading, medical leaves, ya exact home address mangta hai jiska directly public interest se koi lena dena nahi hai, to ise 'Invasion of Privacy' mankar is section ke tehat permanently deny kiya jata hai. Sirf basic posting details aur gross salary bracket publicly disclosable hoti hai.
Section 8(1)(a) & (h) - Security & Investigation: Kisi bhi department me chal rahi sensitive internal vigilence enquiry, raid (chhapemari) planning, ya intelligence sharing ko reject kar diya jata hai kyuki isse investigation ko physical threat ya rukawat (impediment) aa sakti hai.
4. The 'We Do Not Create Data' Concept
CPIO ka kaam RTI application ke mutabiq office me specially naye research paper banana, nayi analysis excel file generate karna, ya law/rules par opinion (jawab) dena NAHI hai.
Supreme Court aur CIC rulings clear karti hain ki RTI ka matlab sirf 'Available Material form data (like PDFs, Notings, Orders)' provide karna hai jo physically ya digitally department ke servers me exist karta hai. Agar applicant puchta hai 'Department ne aisa step kyu (Why) liya?', to CPIO ko answer generate karne ki zarurat nahi, aap boldly likh sakte hain ki RTI act does not compel PIO to answer 'Why/How' hypothetical questions.
