Government Job Me Suspension Aur Departmental Enquiry Ke Rules: Jeevan Nirvah Bhatta (Subsistence Allowance)
Sarkari naukri me power aur security ke sath sath extreme accountability aur discipline bhi aata hai. 1. Suspension vs Termination (The Core Difference)
Termination/Dismissal (Barkhastgi): Ye sabse extreme penalty hai. - Aisa nahi hai ki suspension hamesha boss ke order se hi hota hai. Rules ke according ek 'Deemed Suspension' ka concept hota hai.
- Agar kisi government employee ko police arrest kar leti hai, aur wo 48 ghante (48 hours) se zyada police ya judicial custody (jail) me bita deta hai, to use competent authority dwara automatically 'Deemed Suspended' maan liya jata hai.
- Ye rule tab bhi lagoo hota hai jab employee par koi criminal case proceed kar raha ho ya CBI/ACB trap ka case ho.
3. Salary In Suspension: Subsistence Allowance (Nirvah Bhatta)
Suspension ke dauran karmchari ko regular salary milna band ho jati hai. Lekin constitution kisi bhi insaan aur uski family ko bhookha marne nahi de sakta, isliye rules ke tehat use 'Subsistence Allowance' (Jeevan Nirvah Bhatta) diya jata hai.
Starting Phase (First 3 Months): Shuruati 3 mahine tak, suspended employee ko uski basic pay ki 50% rashi (half basic pay) + us 50% par banne wala poora Dearness Allowance (DA) har mahine milta hai. Iske sath hi HRA bhi milta hai (agar wo headquarter me reh raha ho).
After 3 Months (Review): 3 mahine baad ek review committee case ko dekhti hai. Agar enquiry delay hone me employee ki galti nahi hai (department time le raha hai), to allowance badha kar 75% of basic pay kar diya jata hai. Lekin agar employee khud enquiry me sahyog (cooperate) nahi kar raha, tareekhein aage badhwa raha hai, to allowance ghata kar 25% bhi kiya ja sakta hai.
4. Departmental Enquiry: The Charge Sheet Process
Suspension ke kuch hafton ke andar department ko ek formal 'Charge Sheet' (Aarop Patra) issue karni hoti hai. Isme likha hota hai ki aapne specific rules ka kaun sa violation kiya hai. Employee ko usually 10-15 din ka time milta hai iska written reply dene ke liye.
Agar HOD (Head of Department) reply se satisfy nahi hota, to ek Inquiry Officer (IO) aur Presenting Officer (PO) appoint kiya jata hai. Ye bilkul ek court trial ki tarah chalta hai. Documents pesh kiye jate hain, witness (gawah) aate hain, aur cross-examination hota hai.
Apne defense ke liye, aaropi employee apne department ke kisi dusre serving ya retired employee ko apna 'Defense Assistant' appoint kar sakta hai (bahar ke vakeel/lawyer ko allowed nahi kiya jata normally, unless case exceptionally complex ho).
5. What Happens After Final Verdict?
- Scenario A (Guilty / Doshi paya jana): Agar enquiry me aarop sach sabit hote hain, to major penalties (jaise Demotion, Dismissal, Pension rokna) ya minor penalties (jaise Increment rokna, Censure warning) lagayi jati hain. Suspension period ko 'Non-duty' period maan liya jata hai, aur un mahino ka koi arrears nahi milta.
- Scenario B (Exonerated / Nirdosh paya jana): Ye sabse bada relief hota hai. Agar enquiry me aap ba-izzat bari ho jate hain, to department aapko turant 'Re-instate' (bahal) karta hai. Sabse achi baat ye hai ki suspension me bitaye gaye poore samay ko 'On-Duty' mana jata hai.
- Nirdosh hone par, jo 50% salary aapki kaat li gayi thi, usko 'Arrears' ke form me calculate karke ek lump sum amount aapke bank account me transfer kar diya jata hai, aur seniority par bhi koi daag (spot) nahi lagta.
