Rule 56(j): Sarkari Naukri Me 50/55 Ki Age Me Jabardasti Retirement (Deadwood Rule)

Ek purani kahawat hai ki 'Sarkari naukri milna mushkil hai, par use chhinna (lose karna) usse bhi zyada mushkil hai.' Ye sach tha, par ab nahi. Government ab efficiency aur integrity par maximum focus kar rahi hai. Agar koi karmchari kaam nahi karta, rishwat leta hai, ya baar-baar lambi chhuttiyo par rehta hai (jise admin language me 'Deadwood' kaha jata hai), to sarkar uske 60 saal (retirement age) poore hone ka intezar nahi karti. Fundamental Rules ke Rule 56(j) aur CCS Pension Rules ke Rule 48 ke tehat sarkar ke paas ye absolute power hai ki wo kisi bhi kaam-chor ya bhrasht karmchari ko 3 mahine ka notice dekar forcibly (jabardasti) retired kar sakti hai. 1. What is Fundamental Rule 56(j)?

FR 56(j) 'Appointing Authority' (sarkar) ko ye supreme power deta hai ki wo kisi bhi government employee ko 'Public Interest' (jan-hit) me uski natural superannuation age (60 saal) se pehle hi retire kar sakti hai.

Iske liye sarkar employee ko ya to 3 mahine ka written notice deti hai, ya notice period ki jagah instantly 3 mahine ki salary (pay and allowances) dekar turant kursi khali karwa leti hai. Ise punishment (dismissal) nahi mana jata, ye simply ek pre-mature retirement hai.

2. When Can It Be Invoked? (Age & Service Limits)

  • For Group A & B Officers: Agar in officers ne 35 saal ki age se pehle government service join ki thi, to jaise hi ye 50 Years (50 saal) ki aayu (age) poori karte hain, inka internal review hota hai.
  • For Other Cases (Group C or Late Joiners): Agar unhone late join kiya tha, to unke 55 Years (55 saal) ki umar poori hone par unka review kiya jata hai.
  • The 30 Years Rule (Pension Rule 48): Ek aur rule kehta hai ki employee ki age kuch bhi ho, agar usne 30 Years ki Qualifying Service poori kar li hai, to usko kisi bhi waqt public interest me retire kiya ja sakta hai.

3. The Review Committee (Kaun Karega Tay?)

Sarkar ne har department me ek 'Review Committee' aur ek 'Representation Committee' banayi hui hai. Ye committee har quarter (3 mahine) un sabhi employees ki list mangwati hai jo agle mahine 50/55 ki age ya 30 saal ki service cross karne wale hain.

Committee unki poori Service Book, Vigilance records, aur APARs study karti hai. Agar koi employee physical taur par unfit ho chuka hai, lagatar doubtful integrity (corruption complaints) me raha hai, ya uski productivity almost zero hai (baar-baar low APAR grading), to committee recommendation dekar uski file clearance ke liye bhej deti hai.

4. Is There Pension After Rule 56(j)?

Darrne ki ek limit hoti hai. Compulsory Pre-mature Retirement (56j) aur Dismissal me bada difference pension ka hai. Agar sarkar aapko 56(j) me nikal bhi deti hai, to wo aapki past service ki earning nahi cheen sakti.

Retired employee ko uski service length ke proportional basis par Pension, Gratuity, aur Leave Encashment ka poora haq (full rights) milta hai. Halanki is action ke khilaf candidate Administrative Tribunal (CAT) ya Court ja sakta hai, par zyadatar cases me courts 'Public Interest' wale govt decisions me dakhalandazi (interference) nahi karte.
