Voluntary Retirement Scheme (VRS) vs Resignation: Pension Aur Gratuity Bachane Ke Rules

Ek government employee jab apne career ke mid-phase (45 se 50 ki age) me pahunchta hai, tab family problems, badhti age, ya business karne ki ikchha ke chalte kayi baar wo naukri chhodne ka mann banata hai. Is stage par employees do options ke beech faste hain: Resignation (Isteefa) ya Voluntary Retirement (VRS/Swachhik Sevanivritti). Adhure gyan (half knowledge) ki wajah se agar koi 20 saal service karne ke baad gusse me aakar simple 'Resignation' ka paper HOD ke samne rakh deta hai, to wo apni poori life ki jama ki gayi Pension, Gratuity aur Medical (CGHS) ki facilities ek jhatke me aag me jhok deta hai. Government of India ke CCS (Pension) Rules clearly specify karte hain ki Resignation 'Forfeiture of past service' (purani service ka nash) hota hai, jabki VRS ek aadar-sahit (respectful) exit hai jisme benefits milte hain. Is post me hum in dono terms ke bich ki heavy legal boundary ko samjhayenge taaki service chhodte time koi financial blunder na ho.

1. Qualifying Service For VRS (20 Years Rule)

Voluntary Retirement (VRS) koi candidate apni marzi se kal aakar nahi le sakta. CCS Pension Rules (Rule 43) ke tehat, VRS lene ke liye ek employee ko kam se kam 20 saal ki 'Qualifying Regular Service' poori karni padti hai. (Kuch special categories me 15 saal ka pravdhan bhi hota hai).

Agar aapne 20 saal aur 1 mahina service ki hai, aur aap 3 mahine (90 days) ka advanced notice apne department ko dete hain, to aap formally retired maane jayenge. Aapke boss ke paas ise accept karne ke alawa koi option nahi hota (unless aap par koi corruption charge ya vigilance enquiry pending ho).

2. Financial Benefits of VRS (Retiring With Respect)

  • Pension: OPS walo ko unki proportional basic pension har mahine milti rahegi. NPS walo ko unka retirement corpus 60% cash aur 40% annuity me systematically mil jayega jaisa 60 saal ki umar me milta hai.
  • Gratuity & Commutation: VRS lene wale ko Retirement Gratuity (jo maximum 20 Lakh tak ja sakti hai) aur apni pension ka commutation (ek sath lump-sum bada amount uthana) karne ka full right milta hai.
  • CGHS Facility: VRS wale employee ko lifetime free (ya nominal contribution par) medical coverage CGHS pensioner card ke throw milta hai. Ye unke budhape ka sabse bada sahara hota hai.

3. The Tragedy Of Resignation (Isteefa)

Agar koi employee 25 saal ki clean service kar chuka hai, lekin use private company se bada offer mil gaya aur usne 3 mahine ka VRS notice serve karne ki jagah jaldbazi me 'Simple Resignation' submit kar diya, to Law of Pension kehta hai ki 'Resignation entails forfeiture of past service'.

Iska matlab sarkar manegi ki isne kabhi kaam hi nahi kiya. Use koi monthly pension nahi milegi. Use Retirement Gratuity ki ek kauri (single penny) nahi milegi. Uska lifetime CGHS health card permanently invalid aur cancel ho jayega. Use sirf apne GPF (General Provident Fund) ka apna kata hua paisa wapas milega.

4. Exception: Resignation to Join Another Govt Job

The Technical Resignation Saving: Jaisa humne previous blog me bhi clearly point out kiya hai, yahan sirf ek hi exception (chhoot) hai. Agar aapne Central/State govt ki kisi higher post par qualify kar liya hai, aur aap 'Proper Channel' ke throw Resignation likh kar de rahe hain, tab use forfeiture nahi mana jata.

Tab wo 'Technical Resignation' kehlayega aur aapki purani 15-20 saal ki service naye department me physically add up (carry forward) ho jayegi pension purposes ke liye.
